On the surface, passage of HB1002 seems to provide school districts and other governmental units with a sturdy financial shield against ever-growing and frequent digital record requests. While the bill does include clear protection against certain inadvertent disclosures of otherwise exempt information, provisions allowing districts to charge greater fees for copies of “digital communications” include exceptions that may make that allowance more trouble than it’s worth. This presentation will discuss the amendments along with some of the obstacles or pitfalls related to the expansion of allowable fees for digital communication.

From the adoption of modifications to the fund balance retention law which went into effect in 2021, to legislation passed this year which mandates the disclosure of certain school expenditures and statistics, new legislation which creates an option for the adoption of local tax caps for school districts and a new law to create a local option for SAU apportionment – this presentation will examine new laws and recent experience with existing laws and the impact of these laws on district finances and practices.

NH law allows school districts to finance the purchase of “equipment” via a lease/purchase agreement containing a non-appropriate clause. This can be a useful tool to obtain financing and is less onerous than issuing a bond. This presentation will provide a guide to financing with a lease/purchase agreement including state and federal tax compliance and pitfalls to avoid.
